1. ELIGIBILITY
• The KC Magrath / KCMagrath.com Giveaway #2 (“Giveaway”) is open to individuals who are at least 18 years old at the time of entry, residing in any country EXCEPT where prohibited by law (e.g., Belgium, Brazil, Quebec Canada - other areas of Canada are eligible, China, Colombia, Cuba, France, Hong Kong, India, Iran, Iraq, Italy, Japan, Mexico, Netherlands, North Korea, Poland, Portugal, Russia, Saudi Arabia, South Korea, South Sudan, Spain, Sudan, Sweden, Syria, Taiwan, Yemen).
• Entrants are responsible for ensuring participation complies with their local regulations. The Giveaway is void where prohibited by law.
• Canadian winners (outside Quebec, as Quebec is prohibited from applying) must correctly answer a skill-testing question to claim the prize.
• Employees, affiliates, or immediate family members (spouse, siblings, parents, children) of KC Magrath / KCMagrath.com are not eligible to participate.
• No purchase is necessary to enter or win. A purchase does not increase the chances of winning.
• By entering, participants agree to be bound by these Terms and Conditions.
2. ENTRY PERIOD
• The Giveaway begins on Tuesday, July 22, 2025, at 1500 (3pm) Eastern (NYC, USA Time) and ends on Tuesday, July 29, 2025, at 1500 (3pm) Eastern (NYC, USA Time), the (“Entry Period”).
• Entries submitted before or after the Entry Period will not be considered.
3. HOW TO ENTER
To enter the Giveaway, participants must complete all of the following steps during the Entry Period:
A. EMAIL: Visit KCMagrath.com/about and submit the email form with the subject line “I want to win giveaway 2.” Entrants must answer all of the mandatory fields in order to send the email. Each participant will be assigned a unique entry number based on the order their form is received (first entry = Entrant #1, second = Entrant #2, etc.).
B. LIKE, FOLLOW, COMMENT:, & HASHTAG: LIKE this post, FOLLOW my page, COMMENT on the official Giveaway post with a brief description of your favorite photo & why you want to win it, and the HASHTAG #KCMagrathGiveaway.
***Alternate Method of Entry (AMOE): To enter without a social media account, complete the Email entry step above and include in the form's message field the word "AMOE" along with a brief description of your favorite photo & why you want to win it. No social media interaction is required for AMOE.
• Limit: One entry per person. Multiple entries will result in disqualification.
• Incomplete or Invalid Entries: Entries missing required information or failing to meet eligibility will not be considered.
• Entry Ownership: All entries become the property of KC Magrath / KCMagrath.com and will not be acknowledged or returned.
4. PRIZE
• Prize Description: Two (2) winners will each receive one (1) free high-resolution digital photo download of their choice from the dropdown menu on KCMagrath.com/gallery (approximate retail value: $10- $100 USD, depending on the selected photo; IMPORTANT: please refer to the printing chart at kcmagrath.com/printing prior to choosing a favorite photo.
• The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or other items.
• The prize is for personal use only as described in KCMagrath.com/licensing.
• KC Magrath / KCMagrath.com reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
5. WINNER SELECTION AND NOTIFICATION
• Two (2) winners will be selected via a random number generator based on the assigned entry numbers from valid email form submissions.
• The Sponsor will verify the winners' countries of residence to ensure eligibility, which may include requesting proof of residency (e.g., government-issued ID or utility bill) at the Sponsor’s discretion, securely stored and deleted after verification.
• The winners will be notified via email within 7 days of giveaway closure, and will then be announced publicly on or about Tuesday, August 5, 2025, via a post on Instagram (@kcmagrath) and Facebook (KC Magrath Photographer) and on the Giveaway1 page at KCMagrath.com
• The winners must respond to the DM or email within 48 hours of notification to claim the prize. If a winner does not respond, an alternate winner may be selected.
• The download link for the prize will be sent to the email address provided in the contest form unless an alternative email is provided by a winner.
• The winners will have 7 days from notification to securely download the prize.
• The winners first names, usernames, and countries of residence (or first name and country of residence for AMOE entrants) will be publicly shared in the announcement posts and on kcmagrath.com/giveaway2 subject to consent.
6. PRIVACY AND DATA USE
• By entering, participants consent to the collection and use of their name, email, and country of residence for Giveaway administration and winner notification, as recorded via the mandatory email fields on KCMagrath.com. Marketing opt-in is separate and optional via the form.
• Participants who opt in for marketing communications may at anytime opt out by following unsubscribe instructions in emails or contacting KC Magrath at KCMagrath.com/contact.
• Personal data will be securely stored, used solely for Giveaway purposes, and not shared with third parties except as necessary to administer the Giveaway or as required by law, in compliance with the Privacy Policy at KCMagrath.com/privacy.
• Data will be handled in accordance with applicable privacy laws, including GDPR for UK/EU residents.
7. GENERAL CONDITIONS
• KC Magrath / KCMagrath.com reserves the right to cancel, suspend, or modify the Giveaway due to fraud, technical failures, or any factor beyond its control that impairs the integrity of the Giveaway.
• The Giveaway is void where prohibited by law.
• Participants agree to comply with all applicable laws and the rules of Instagram and Facebook.
• Any attempt to undermine the legitimate operation of the Giveaway (e.g., using bots, multiple accounts, or fraudulent entries) may result in disqualification and legal action.
8. RELEASE AND LIMITATIONS OF LIABILITY
• By participating, entrants agree to release and hold harmless KC Magrath / KCMagrath.com, Instagram, Facebook, and their respective affiliates, officers, and employees from any claims, damages, or liabilities arising from participation in the Giveaway or acceptance/use of the prize.
• This Giveaway is not sponsored, endorsed, administered by, or associated with Instagram or Facebook.
9. GOVERNING LAW
• The Giveaway is governed by the laws of the state of Florida, USA, with UK law applying to UK/EU participants. Any disputes will be resolved in the courts of Florida, USA, or UK courts for UK/EU residents as applicable by law.
